The Bombay High Court on Tuesday extended the interim order given by the lower court in Kangana Ranaut’s case, barring the Mumbai civic body from taking any action against the alleged irregularities in the actor’s flats in Mumbai till 5 February. The court asked them to be informed. The said date, if applicable to the Brihanmumbai Municipal Corporation (BMC), will demand regularization of the alleged unauthorized changes.
In March 2018, BMC issued a notice to Ranaut for alleged illegal merger of three flats owned by him in the Orchid Breeze building in suburban Khar. In September last year, BMC demolished parts of Kangana’s office in Bandra citing illegal construction. Following the demolition, Kangana filed a petition seeking a moratorium on the demolition being carried out by the civic body.
On Tuesday, Kangana’s lawyer Birendra Saraf told the High Court that “retaliation” was being done against him. The illegal construction was done by the developer and not by Ranaut, he protested.
The HC asked the BMC lawyers if there was a moratorium on regularization. He informed the court that an application for regularization is usually filed within 30 days from receiving the notice. “In this case, he is already three years late. But the court can delay, ”the lawyer said. The court adjourned the hearing till Friday.
In a recent decision by the civil court, Judge LS Chavan cited that to merge her three flats on the fifth floor of the 16-storey building, Kangana covered the submergence area, duct area, common passage and free floor space in the index. Changed. (FSI) in the habitable zone. This, according to the ruling, was a serious violation of the building plan.
